1. Who we are

Adsynq AI Technologies Ltd ("AdSynq", "we", "us"), registered at Suite A4, 9131 Keele St, Concord, ON L4K 0G7, Canada, operates the AdSynq ARECS platform. This policy explains what personal data we collect, why, and the rights you have over it. We write this to the standard set by the EU/UK GDPR as our baseline, layering in Canada's PIPEDA and India's DPDP requirements where they apply, so it holds up regardless of where you or your customers are located.

This policy covers two groups of people, whose data we handle differently: store staff (the businesses and their employees who use AdSynq directly) and shoppers/customers (the end customers of those stores, whose data a store submits into the Service, or who create their own shopper account to try on products and manage their own preferences).

2. What we collect

From store staff (the businesses using AdSynq)

From shoppers/customers (submitted by a store, or entered directly by the shopper)

From Meta, when a store connects its WhatsApp Business account

A store owner connects WhatsApp by logging in with Facebook in Meta's own sign-up window and choosing which WhatsApp Business account and number to share with AdSynq. From Meta we then receive and store:

We use this data only to send that store's WhatsApp messages, manage its message templates, show its WhatsApp status in AdSynq and receive delivery updates. We do not sell it, share it with other stores or third parties, or use it for advertising. When the store disconnects WhatsApp in AdSynq, or removes AdSynq's access in Meta, the access token and PIN are deleted.

WhatsApp conversations

When a customer sends a WhatsApp message to a store's own number, Meta passes it to us and we keep it in that store's conversation with the customer, so the store's staff can read it and reply from AdSynq. The conversation also holds the messages the store sends from AdSynq, the messages it sends from its WhatsApp Business app on the same number (Meta sends us copies so the conversation is complete) and, if the store brings over its earlier chats when connecting, the chat history Meta shares at that point. Message text is stored encrypted and is shown only to that store's staff. For photos, videos, voice notes and documents we keep only the type of file, never the file itself. A STOP request stops that store's WhatsApp messages to the person. A sign-in code a shopper sends to AdSynq's own number signs them in; those messages are not kept. We link the sender's WhatsApp user ID to their customer record at that store. We don't use conversations for advertising, don't share them with other stores and don't use them to train AI models.

3. Why we process this data (legal basis)

4. How we use it

To operate the Service (CRM, try-on, follow-ups, offers, loyalty, order requests, fulfillment tracking), to bill store subscriptions, to communicate with you about your account, to provide support, to detect abuse and keep the platform secure, and to improve the product. We do not sell personal data.

AI phone calls and recordings

A store can use AdSynq's AI voice assistant to call its customers or to answer their calls. Every call begins by saying that the caller is an automated AI assistant for that store and that the call is recorded. The assistant handles only the store's own tasks, such as appointments and follow-ups, and can pass the call to a person at the store.

We record the call and keep a written transcript and summary so the store can review it. Recordings and transcripts are deleted automatically after the period the store chooses — 90 days by default, or up to one year. Basic call details (time, length, outcome) stay with the customer's record.

AI calls are only made to customers who have agreed to be contacted by phone by that store, and only within local calling hours. A customer can ask not to be called again at any time — during the call or by asking the store — and we stop further AI calls to them.

5. Who we share it with

We share data only with the service providers that make the Service work, under contract, and never for their own marketing purposes:

Share buttons: when a store's staff member uses a “Share on WhatsApp” button (for example on an estimate or an order), the document text is handed to that person's own WhatsApp app on their device. AdSynq does not send it; what happens next is between that person and WhatsApp.

We never share shopper data with a store other than the one the shopper interacted with. We never share data for any store's or third party's independent marketing use. We do not sell personal data to anyone, ever.

Text messages (SMS): mobile numbers and SMS opt-in or consent are never shared with third parties or affiliates for marketing or promotional purposes. They are shared only with the providers that deliver texts for us, listed above. Message and data rates may apply. Reply STOP to any text to stop texts from that sender, or HELP for help.

6. Data retention

7. International transfers

AdSynq is a Canadian company; the Service is used by stores and shoppers globally. Where we transfer personal data across borders (e.g. to infrastructure or sub-processors located outside your country), we rely on appropriate safeguards recognized under applicable law (such as standard contractual clauses).

8. Your rights

Subject to applicable law (GDPR, PIPEDA, DPDP, or other regional law), you have the right to:

To exercise any of these rights, contact us at legal@adsynqai.net.

How to ask for your data to be deleted — including data connected to WhatsApp — is explained on our data deletion page.

9. Marketing communications

Marketing emails from AdSynq itself (about new features, offers, etc.) are opt-in — we only send them if you've checked the marketing box at signup or otherwise opted in, and every marketing email includes an unsubscribe link. This is separate from the transactional/account emails we need to send you regardless (e.g. billing notices, security alerts) to operate your account.

Marketing messages a store sends to their own customers through the Service (follow-ups, offers) are governed by that store's own consent records with their customer, per-channel, which the Service enforces at send time — a store cannot message a customer on a channel that customer hasn't consented to.

WhatsApp: a store can only message a customer on WhatsApp after that customer has opted in to messages from that store; the opt-in names the store. A customer can stop at any time by replying STOP, by using WhatsApp's own option to stop a business's promotions, or by asking the store. AdSynq records the opt-out and stops that store's WhatsApp messages to them.

10. Children's privacy

The Service is not directed at children under 16, and we do not knowingly collect personal data from them.

11. Security

We use industry-standard safeguards including encryption in transit and at rest, field-level encryption for sensitive data, tenant isolation between stores, and access controls, and we log access for audit purposes. No system is 100% secure, but we take these obligations seriously.

12. Changes to this policy

We may update this policy from time to time. Material changes will be notified to you (e.g. by email or in-app notice) before they take effect.
